STUDIO HIRE - TERMS & CONDITIONS

1. Rental Period and Rates
a. Rental Period: The Studio will be available to the Client for the time agreed upon in the booking confirmation. Any additional time will be billed at an hourly rate.
b. Rental Rates: Rates are as specified in the booking confirmation and are based on the hourly or daily rate set by the Studio.

2. Payment Terms:
The total rental fee is required to secure the booking and the shoot date. Payments can be made by bank transfer or online through booking app.
a. A booking is only considered confirmed from our side once the invoice is paid, unless agreed in writing with STUDIO ENDURA LTD.
b. Any additional services, such as Coloramas, will be invoiced after the shoot and are due on receipt of invoice or can be added in the first instance when booking via the website app.
c. Late payment will incur a 10% surcharge for the specific booking
d. Any booking that runs outside the booking time will incur an overtime charge of £80/hour. Overtime hours outside the normal working hours are charged £100/hour.
e. Coloramas cost £12/meter used touching the floor
f. If invoices haven’t been paid within the time stated in the booking confirmation email, STUDIO ENDURA LTD. will automatically charge the card that was used to place the booking.
g. Set-up and pack-down time should be included within the hours of your booking. Clients won’t be allowed into the studio prior to the start time in their booking confirmation and will be expected to leave promptly at the end time of their booking.
h. Anything damaged/missing will be charged at full price plus administration/restock charge (£15 admin fee).
i. Clients will be charged a discretional fee of £40 if the Studio is not left clean and tidy and in its original condition. This is to compensate the Studio’s employees time for cleaning. To avoid cleaning charges, Clients must speak to STUDIO ENDURA LTD at the end of their booking.

3. Cancellation and Rescheduling
a. Cancellation Policy: Cancellations made more than 7 days before the rental date will receive a full refund of the deposit. Cancellations made within 7 days of the booking start date will receive 50% refund of the deposit. The other 50% will be retained by STUDIO ENDURA LTD.
b. Clients who cancel within 48-hours prior to the start time of the booking or fail to appear for a booking will be liable for 100% of the booking fee.
c. Rescheduling: Rescheduling requests must be made at least 5 days in advance. Approval is subject to studio availability
and may incur a rescheduling fee.

4. Use of Studio and Equipment
a. Permitted Use: The Studio may only be used for photography, videography, and other approved media-related purposes. The Client may not use the Studio for unlawful or unauthorised activities, smoking and drinking alcohol are not permitted in the studio.
b. Studio Equipment: Studio equipment in the list openly stated (stool, props, etc.) is included in the rental fee. Additional fees may apply for specialty equipment. The Client is responsible for returning all equipment in the condition it was provided.
c. Damage to Equipment or Studio: The Client is liable for any damage to equipment or Studio facilities caused by negligence or misuse during their booking. The Studio reserves the right to charge for repair or replacement costs.
Any marks, spillages or damages caused to the Studio during the hire period must be attended to before the end of the hire period.
d. No alterations, decorations or additions to the studio are permitted without written consent from STUDIO ENDURA LTD.
e. The client must notify STUDIO ENDURA LTD at the time of supply if the condition of equipment is not acceptable or fit for intended use.
f. All damages must be paid within the invoice.
5. Studio Access and Use
a. Access: The Client and their guests will have access to the Studio only for the duration of the rental period. The Client is responsible for ensuring the Studio is secured at all times.
b. Cleanliness and Organisation: The Studio must be left in the same condition as it was found. The Client agrees to clean up any mess created during the rental period.
c. Capacity: The maximum number of occupants allowed in the Studio is 25 people. Exceeding this number without prior approval may result in additional fees or termination of the rental agreement violates any of the terms and conditions.

6. Client Responsibility and Liability
a. Insurance: The Client is responsible for obtaining any necessary liability insurance to cover their activities and property within the Studio.
STUDIO ENDURA LTD is not responsible for injuries, accidents, or damages incurred by the Client or their guests during the rental period.
b. Indemnity: The Client agrees to indemnify and hold harmless STUDIO ENDURA LTD And its owners, employees, and affiliates from any claims, damages, or losses arising from the Client’s use of the Studio.

7. Photography and Media Rights
a. Usage Rights: The Studio grants the Client a temporary right to use the premises for media production during the rental period. Any intellectual property created during the session is owned by the Client unless otherwise agreed.
b. Studio Promotion: The Studio reserves the right to take behind-the-scenes photographs for promotional use, with the Client’s consent. The Client may decline this by notifying the Studio before the rental period.

8. Termination of Rental
a. Breach of Agreement: STUDIO ENDURA LTD reserves the right to terminate this Agreement and end the rental period immediately if the Client violates any of the terms and conditions.
b. Refund Policy: In the event of termination due to the Client’s breach, no refunds will be given. In the case of Studio-initiated termination for reasons outside the Client’s control, the Client will receive a refund for the unused portion of the rental period.

9. Governing Law
a. This Agreement shall be governed by the laws of England and the United Kingdom. Any disputes arising from this Agreement shall be resolved in the courts of England and the United Kingdom.

10. Acceptance of Terms
a. By signing below, the Client confirms that they have read, understood, and agreed to the Terms & Conditions outlined in this document. This agreement is binding upon confirmation of the booking.

SETS / PROPS / LIGHTING / CLOTHING

All props are to be delivered and collected on the same day of hire unless other arrangements have been previously made and agreed by STUDIO ENDURA LTD.

If agreed by STUDIO ENDURA LTD, props may be delivered to the Studio before the day and start time of the Client’s shoot. The Client is responsible for confirming the delivery and receipt of their items/property at the Studio. Epitomestudio Ltd employees are not responsible for Client’s property but can facilitate these requests made in advance for a fee of £50 for labour.

STUDIO ENDURA LTD cannot be held responsible or liable for any items damaged or lost during the hire or left on site.

The Client will be charged an additional cost for the disposal, storage or transportation of any items left on site and not collected.
EQUIPMENT RENTALS - TERMS & CONDITIONS

Terms & Conditions of Service
This Agreement governs the hire of equipment and/or services provided by STUDIO ENDURA LTD ("Studio Endura") to the Client ("Client" or "you") as outlined in the accompanying hire schedule (the “Schedule”). By taking possession of the hired equipment, and/or by entering into this Agreement, the Client agrees to be bound by the terms set out below.
DEFINITIONS
“Terms and Conditions (T&Cs)”: The terms and conditions outlined in this document, including all schedules and referenced documents.
“Client”: The individual or entity entering into the agreement to hire the equipment or services.
“Epitomestudio”: The company that owns and provides the equipment or services for hire.
“Parties”: The Client and STUDIO ENDURA LTD.
“Equipment”: The items or materials being provided on hire, including cameras, lighting equipment, furniture, kitchen equipment, props, clothing, or any other items included in the order.
“Services”: Any services provided by STUDIO ENDURA LTD, including but not limited to photography, videography, and image editing.
“Hire Period”: The agreed period during which the equipment or services are hired, starting and ending on the dates specified in the order.
“Hire Fee”: The total amount payable by the Client for the hire, including rates, delivery charges, and applicable taxes.
“Security Deposit”: Any upfront refundable payment intended to cover potential loss, damage, or breach of contract.
“Loss or Damage”: Any theft, breakage, wear beyond reasonable use, or disappearance of the hired item, or damage to the hired space.
“Force Majeure”: Events beyond either party’s reasonable control (e.g. natural disasters, strikes) that may prevent fulfilment of obligations.
“Working Day”: A business day, typically Monday to Friday, but could include weekends and Bank Holidays depending on the agreement.
1. Consideration
1.1 This Agreement is entered into in consideration of the mutual promises contained herein, including the provision of insurance evidence (Clause 11), and the exchange of £1 by each party to the other, the receipt and adequacy of which are acknowledged.
2. Ownership
2.1 Title to all equipment remains with STUDIO ENDURA LTD. The Client agrees to return the equipment in full. Any unreturned items shall be charged at full replacement value (as new).
3. Equipment Hire
3.1 Hire Period and Chargeable Days: The hire period begins at the time stated in the order or upon collection/delivery to the Client or their representative.
a) If early collection is approved, the hire period begins once the equipment leaves STUDIO ENDURA premises.
b) The hire period ends upon return to STUDIO ENDURA LTD or collection by an authorised employee.
3.2 Extension / Cancellation of Hire:
a) No charge applies if cancellation or changes are made more than 24 hours in advance.
b) Cancellations made less than 24 hours before the agreed time may incur a one-day charge at full rate.
c) Failure to provide cancellation notice will result in a minimum charge equivalent to one full day at the standard rate.
3.3 Equipment Receipt: It is the Client’s responsibility to check that the received equipment matches the order. Any discrepancies or damage must be reported immediately.
3.4 Return of Equipment:
a) Equipment must be returned by the Client or collected by STUDIO ENDURA LTD if arranged.
b) Returns must be made by the time and date stated in the schedule.
c) Returns must occur during business hours and be handed to an employee.
4. Payment
4.1 The hire fee (the “Quote”) is based on the Equipment and Hire Period and is payable in full on or before the start of the Hire Period, unless otherwise agreed in writing.
4.2 All payments must be made via debit/credit card or through bank transfer. Cash is not accepted.
4.3 Prices include VAT at the applicable rate.
4.4 Payments must be made in full without deductions or set-offs unless required by law.
5. Transport
STUDIO ENDURA LTD is not liable for delays in delivery or collection. Waiting time may be subject to additional charges.
6. Limitation of Liability
6.1 The Client is liable for any loss or damage caused by themselves or any third party they allow to use the equipment.
6.2 It is the Client’s responsibility to ensure the equipment meets their requirements during the Hire Period.
6.3 Epitomestudio’s sole liability is to repair or replace faulty equipment.
6.4 This does not affect the Client’s payment obligations.
6.5 All implied warranties are excluded as far as permitted by law.
6.6 Epitomestudio is not liable for costs from equipment failure, including overtime, travel, or reshoots.
6.7 No liability exists if hire fees are unpaid by the due date.
7. Supply of Kit
STUDIO ENDURA LTD will make reasonable efforts to supply booked equipment but is not liable for non-availability due to late returns, failure, or Force Majeure. Alternatives may be provided at their discretion.
8. Media, Digital Capture & Storage
a) If Client media is damaged, liability is limited to the declared value or rental value if not disclosed.
b) STUDIO ENDURA LTD does not store data. All media is wiped upon return. Data storage is the Client’s responsibility.
9. Warranties by STUDIO ENDURA LTD
9.1 STUDIO ENDURA LTD warrants that it:

Is properly incorporated and authorised to enter this Agreement.

Will supply equipment in good working order.
-
Is not breaching any other agreements.
10. Client Warranties and Indemnity
10.1 The Client warrants that equipment will be:
-
Used responsibly and by trained personnel.
-
Not used in hazardous areas without consent.
-
Reported if damaged or malfunctioning.
-
Not repaired independently.
-
Stored securely and returned on time.
10.2 The Client indemnifies STUDIO ENDURA LTD for any claims arising from breach or misuse.
11. Title, Risk, and Insurance
11.1 Title remains with Epitomestudio.
11.2 Risk transfers to the Client on delivery and until return.
11.3 STUDIO ENDURA LTD is not liable for:

Damage to Client property (unless negligent),

Indirect loss,
-
Data loss.
11.4 Liability is capped at fees paid, unless gross negligence or fraud.
11.5 The Client must provide: -
Full replacement value insurance,
-
8-week loss-of-hire cover.
11.6 Third-party insurance is mandatory for items over £5,000.
11.7 For items under £5,000, Clients may opt into a Damage Waiver.
11.8 Waiver clients must pay the Waiver Fee and cooperate fully.
11.9 STUDIO ENDURA LTD may decline Damage Waiver cover.
11.10 Insurance claims must be directed to Epitomestudio Ltd.
12. Termination
12.1 STUDIO ENDURA LTD may terminate the agreement immediately if:

Payment is overdue,
-
Terms are breached,
-
The Client becomes insolvent.
12.2 Upon termination:

STUDIO ENDURA LTD may repossess equipment.
-
Fees become payable within 14 days.
13. Safety
STUDIO ENDURA LTD is indemnified against any harm or damage caused by use of the equipment, including electrical faults.
14. Client Responsibilities
a) Follow manufacturer guidelines.
b) Use only trained personnel.
c) Ensure safe power sources.
d) Comply with all transport regulations.
15. Loss
Failure to return equipment on time is a default. STUDIO ENDURA LTD may repossess items and recover costs. The Client waives claims for resulting damage.
16. Damage
If damage is discovered post-return, the Client will be informed and agrees to pay for repairs.
17. Default and Legal Fees
In the event of default, Epitomestudio may recover legal fees and other related costs.
18. Sales Return Policy
Sales items (e.g. consumables) are returnable only if faulty or misdescribed. No refunds are issued otherwise.
19. Pricing and Discounts
Prices may be adjusted if third-party equipment is sourced. Discounts are non-transferable.
20. Damage Waiver Policy
20.1 The Damage Waiver applies to hires under £5,000.
20.2 Covers accidental physical damage during responsible use.
20.3 Excludes theft, negligence, unreported damage, and accessories.
20.4 Charged at 10% of the hire fee, minimum £25.
20.5 Excess: £350 per incident or full repair cost if less.
20.6 Clients must provide ID, report damage promptly, and cooperate fully.
20.7 The Waiver is not insurance.
20.8 STUDIO ENDURA LTD may withdraw the Waiver at its discretion.
21. Governing Law & Dispute Resolution
21.1 This Agreement is governed by the laws of England and Wales.
21.2 Disputes shall be resolved via good-faith negotiation, then mediation. If unresolved, the parties submit to the jurisdiction of the courts of England and Wales.
